“Always allow your opponents the opportunity to walk away from the table with dignity because tomorrow they might be your friends”

William Brown, former mayor of San Francisco, quoted in The Times

Core celebrates its fifth birthday!

It is five years since Core’s very first event, “Communicate to Persuade”, held at the Royal Society of Edinburgh in January 2001. Later this year, in the summer, we will celebrate the fifth anniversary of Core’s first mediation.

In the coming weeks, Core will pass the century mark in completed mediations, half of these coming since the beginning of 2005. At the time of writing, 5 of our panel mediators are engaged in mediations in the space of 7 working days. How things have developed.

Our in-house and other specialist training courses are constantly being updated and improved to meet growing demand.

To celebrate our fifth birthday, we will hold our annual dinner again this year in May (Thursday 11th). Last year’s event was a great success and we hope to welcome an interesting guest or two for another fireside (or, as last year, barrel-side) chat.

Expansion of Core Panel

Celebrating a sustained period of growth necessitates looking forward. We are delighted to announce an expansion of Core’s panel of mediators and facilitators in response to the increased demand for our services both within and out-with Scotland and the UK (more below). We welcome Judith Scott, a distinguished forensic accountant, and David Fraser, a senior corporate executive and adviser and engineer by profession. Take a look at the Panel page on our website (click here) to view the enhanced profiles of the Core team.

We are also delighted to announce that the international dimension to our panel is enhanced by Bill Marsh of Conflict Management International, one of the world’s leading advisers in mediation development and a much sought after mediator, and Charles Dodson, a senior figure in the mediation world in London and elsewhere and regular coach on Core mediation courses. Both are highly ranked in the Chambers Guide. When added to our existing London-based and internationally recognised mediators and coaches, Heather Allen and Miryana Nesic, this represents a strong commitment to developing Core’s ability to serve on an international basis.

Core offers a without commitment initial discussion or meeting to help you to decide whether or not and, if so, how mediation can bring benefits to a dispute or difference.

Emerging international links

Heather Allen, Miryana Nesic, John Sturrock and Mary Skelton Roberts, a mediator and conflict resolution strategist from Boston, USA, are leading a session on “Coaching in Managing Conflict” at the annual ABA conference on Dispute Resolution in Atlanta, Georgia, in April (conference details below).

In December, John Sturrock mediated a contractual dispute between a large manufacturer of a global product and one of its distributors. The mediation took place in Geneva and achieved resolution of all issues. In March, John is heading further afield to mediate over four days in a delicate multi-party matter. As a participant in mediation recently commented:

“The valuable process of mediation has forged co-operation in place of confrontation and has seen a greater objective concentration on the issues.… both parties have for the first time been able to express their positions and views….without fear…”

Core in the News

Pamela Lyall was quoted in the Scotsman’s preview of the year ahead on January 10. She said:

"2005 was a breakthrough year for mediation, especially in commercial, business, professional and organisational disputes. In 2006, we would like to see Scottish courts more active, like their counterparts in England and other countries, in encouraging the use of mediation to reduce the number of cases which sit in the court system for long periods of time.

This will free up the courts to deal with cases which only judges can address and, at the same time, enable businesses and individuals who have got disputes to get these resolved much more quickly and efficiently. I'd also like to see law firms building on the significant changes which many have already adopted in their approach to helping clients solve problems at an early stage."

Business Insider magazine carried an extensive piece on mediation in its January edition. Core was featured and “widely credited with significantly raising the profile of mediation in Scotland”. Chambers UK Guide to the Legal Profession has named John Sturrock in its group of the UK’s leading mediators and described him as “one of the best teachers of mediation”. Which takes us to....

Mediation Course

With two months to go, Core’s flagship course is already more than two thirds subscribed, with a few more places left. We are delighted to have a diverse and interesting group of people signed up for the course. So far, they come from the length and breadth of Scotland, from Russia and England and from the health sector, public service, commerce, banking, construction, legal practice and athletics, to name a few!

The dates are March 27- 30 for the mediation skills module and April 19 - 21 for optional assessment. Click here for more information or contact Kevin Paterson on 0131 221 2520.

Advance Notice: Drafting Dispute Resolution Clauses – Miryana Nesic – Friday 12 May.

Master Class

In Aberdeen on Monday 30 March, for those who have participated in or have an interest in using mediation, a discussion of the best practices emerging for solicitors, mediators and others. Local practitioners will talk about their experience of what works – or doesn’t work - in mediation.

Contact Lisa Garrow or call 0131 221 2520 to reserve a place.

Health Sector Mediation

Core has established a small team of trained mediators with particular interest in and awareness of health sector issues. The team is available, working individually or alongside Core’s lead mediators, to assist in matters involving internal management issues, GP practices, complaints, patient / doctor relationships, medical negligence claims and other differences.

The team includes Dr Robert Hendry, Dr Neil Houston, Dr David Morton (all practitioners with a range of expertise and experience in the health sector) and Olivia Giles, formerly a solicitor in private practice, who has a special interest in the NHS.

Core Foundation

Core is committed to supporting local and international initiatives to enhance the understanding of conflict resolution among young people – and more generally to support young people in skills development. Initially, this includes maintaining our links with the Diploma mediation workshops at Strathclyde University and offering a discounted place on our mediation course for a young professional (see below). It will also involve sponsoring the Scottish Cricket Union’s youth development programme this year!

Young Professionals

In May, Core will launch its forum for young professionals who have trained as mediators or who have a special interest in its development. As part of that initiative, Core will offer a discounted place at an upcoming mediation course for a young professional who could not otherwise take part and who shows special aptitude for and interest in mediation. Please contact Kevin Paterson if you are interested in this initiative.
